[ESMA31-62-1258 Prospectus Q&A 3.4] Yes. Article 12(2) to (3) PR clearly state that the end of the validity of an RD or a URD shall not affect the validity of a tripartite prospectus of which it is part. Accordingly, it continues to be possible to supplement the information in an expired RD or URD that is used in a valid tripartite prospectus by supplementing the tripartite prospectus itself. ESMA notes that Article 23(5) PR still applies to supplements concerning the information in an expired RD or URD. The competent authority for approving the existing RD or URD is responsible for approving such supplement to the tripartite prospectus pursuant to PR Article 26(5).
