Article 23 - Application of partial settlement
1.
Where on the last business day of the extension period referred to in 2014, some of the relevant financial instruments are available for delivery to the receiving participant, the receiving and failing clearing members, trading venue members or trading parties, as applicable, shall partially settle the initial settlement instruction unless the conditions set out in Article 12(1) of this Regulation are fulfilled.

The first subparagraph shall not apply where the relevant settlement instruction is put on hold in accordance with Article 8.
