Article 104 – 1. ⬅️ | ➡️ Article 105 – In order to ensure uniform conditions of application of the provisions in this Directive concerning the exchange of information, ESMA may develop draft implementing technical standards to determine the conditions of application with regard to the procedures for exchange of information between competent authorities and between the competent authorities and ESMA.
Article 104a - 1.
Member States shall apply Directive 95/46/EC to the processing of personal data carried out in the Member States pursuant to this Directive.
2.
Regulation (EC) No 45/2001 of the European Parliament and of the Council shall apply to the processing of personal data carried out by ESMA pursuant to this Directive.
